Which US states require two-party consent for voice recording?
Twelve US states require all-party consent before any voice recording can take place — meaning every participant must agree, not just one. The federal Wiretap Act under 18 U.S.C. § 2511 uses a one-party consent standard, but state law sets the stricter floor that actually governs your workflow.

- Emotion recognition and biometric categorisation. Deployers must inform exposed individuals. Standard dictation does not perform either function.
- Deepfakes and AI-generated text published to inform the public. Deepfake disclosure is required. A doctor dictating clinical notes is not publishing to inform the public; a consultant generating a press release with an LLM may be.
The European Commission’s draft guidelines on Article 50, published on 8 May 2026, confirm this scope: routine professional transcription is not within the heart of Article 50, although the underlying GDPR obligations on voice data continue to apply.
How does HIPAA interact with AI dictation and recording consent?
HIPAA and state recording-consent laws form two distinct compliance layers that both apply to healthcare professionals. HIPAA governs Protected Health Information once it exists; state wiretap laws govern whether the recording is lawful in the first place.

- HIPAA layer. A Business Associate Agreement with the vendor is mandatory because the scribe processes PHI. The Notice of Privacy Practices must describe the use of AI-assisted documentation. The Security Rule risk analysis must include the new data flow.

ABA Formal Opinion 512, issued in July 2024, sets the framework for lawyers using generative AI tools. The opinion ties three existing Model Rules to AI use: Rule 1.1 (competence), Rule 1.4 (communication) and Rule 1.6 (confidentiality of client information).
